

Guidelines, Rules & Regulations
Introduction
Our Marenal community is comprised of freedom-loving, peaceful individuals and their families who seek an independent lifestyle in a healthy, safe environment.
For this and other reasons, Marenal has been organised as a Gated Agricultural Community (GAC) with a dynamic governance system. You will find a more detailed description of this concept on the second page of “What is Marenal” on our website.
Marenal will eventually be a community of 40 (forty) property owners. 18 (eighteen) properties are offered in Phase I. There are 15 (fifteen) residential lots and 5 (five) Commercial Lots.
Marenal FGK, S.A. is the owner of all properties, including Franz X. Meier’s personal lots (R-1 and R-2), of which Meier is the sole shareholder. Franz is a full-time resident of Marenal and is bound to all community guidelines rules and regulations.
Each purchaser of a residential or commercial property will automatically become a Member of our Community Owners Association (COA). Only the owners of the residential and commercial properties have voting rights. One vote per property will be allocated.
When 10 (ten) properties have been sold, the members of the COA (Community Owners Association) may decide to form a Board of Directors, which will then assume control of the COA. Until such time, Marenal will be managed by Franz Meier, and Ariana Ugalde, the manager of GLP (Ganadera Los Pilones).
After the Community Owners Association Board of Directors is formed, MFGK and GLP will establish specific, common-sense Guidelines, Rules, and Regulations (GRR) intended to create a harmonious and safe environment for the Community. The purpose of the GRR is to define the responsibilities of the Owner of the Marenal properties (MFGK), the Community Manager (GLP) and the Members of the Community Owners Association (COA). When the Board of Directors of the COA is established, it will assume responsibility for enforcing and/or modifying the Community's Guidelines, Rules, and Regulations (GRR).
These GRR will be devised to be brief and straightforward, because the Association members will be consist of people with a practical and reasonable outlook and who will have no need for long-winded legal documents to enjoy a life of liberty and Pura Vida. These GRR will protect owners and users against interference and misuse, ensuring the enjoyment of everyone in Marenal. In the event that conflicts arise, the GRRs will also provide guidance for the resolution of differences between property owners, their friends or guests and the management of Marenal.
With this in mind, we present the following guidelines, rules and regulations
A.) MFGK Responsibilities:

The Owner of MFGK shall be responsible for providing road access and water to each build-ready property.

Electricity and Internet requirements shall be a part of the design criteria for each home and can be provided by MFGK or the property owner.
B.) GLP Responsibilities:
GLP will:

Maintain all properties within MARENAL, including the identified construction areas of each property, until the purchaser takes possession.

Be responsible for all plantings and harvesting of all agricultural products.

Maintain the grounds of all shared facilities and provide for the upkeep, repair and maintenance of all community buildings and equipment.

Keep the interior roads and community walkways in reasonable condition.

Operate and maintain the gated Community entrances and any interior gates.

Be responsible for security services and surveillance equipment.

Provide information and guidance for trash removal and recycling.

Prepare an operating budget and establish the fees and charges due from the property owners, with the assistance of the COA Board, after the board is established.

Handle all insurance requirements for the Community and assist members with their personal insurance obligations, if required.

Manage the community's water requirements with the Nuevo Arenal water department.
C.) Member Responsibilities:
Each property owner:

Will be responsible for his proportionate share of all community common area expenses.

Will be responsible for the cost of maintaining his building site.

Will be obliged to pay his community fees promptly when received.

Must establish an account with the local utility company and pay the charges for his power usage, his water consumption and internet connection, if applicable and pay promptly when due.
D.) Additional Guidelines and Rules:

A licensed architect registered in Costa Rica must design all residences, with the owner’s requirements in mind.

Only builders approved by the GLP will be eligible to construct homes.

All homes shall be positioned on the building site in a manner that will protect the owners’ view corridors.

The size of each home, including the garage, must be at least 150 square meters.

All homes must have a covered garage for motor vehicles.

The design and location of any structure on a member’s lot must be submitted and approved by GLP before applying for a municipal building permit.

All utility lines to the home shall be underground, where possible.
-
Each residential property shall have its own septic system.
-
All homes shall have a water management system to control roof runoff.
-
All properties without access to public utilities will have an off-grid power system designed to meet the power requirements of each dwelling.

Only natural plants are allowed for lot separations. No chain-link fences are permitted.

Property owners must observe rules established for domestic pets, music and other noise-producing equipment and events.

Property owners and their guests must be familiar with the use and maintenance of all common areas and facilities.
Please note: All property owners must grant GLP the right to use and maintain the portion of their legal property that is not identified and designated as their construction site. The conditions and the above GRRs must be accepted before the investment is concluded, as these will become a part of the Purchase and Sale Agreement (PSA).
